He said that  the refusal reflects  that Equal justice under law does not mean same thing for 3.6 million citizen of us as it does for everyone.

The Constitutions says that anyone born or naturalized in us is a citizen in US.

Insular cases was series of cases decided after Spanish war.

The Cases held full constitutional rights apply only to incorporated territories such as Hawaii.

And not to unincorporated territories like Philippines, Guam and Puerto Rico.
